Telehealth and Privacy: Federal Guidance for SUD and Mental Health Treatment Providers

Providers of SUD and mental health services are working rapidly to make sure their patients have access to the care they need during the COVID-19 pandemic.

Resource developed by the CoE-PHI to assist health care providers with ensuring patient privacy when providing telehealth services in response to the Covid-19 pandemic and beyond, including information on telehealth apps, executing consent forms and disclosing health information when a medical emergency exists.

Key Points

  • Providers should try to avoid public wi-fi, password protect their devices, and keep any confidential files secure.
  • In-person consent for sharing protected health information is not needed.
  • Providers can make their own determinations regarding whether a “medical emergency” exists.
